Right of withdrawal (consumers)
You have the right to withdraw from the contract within 14 days without giving any reason. The period runs from the day on which you or a third party designated by you physically receive the goods (delivery).
How to exercise withdrawal
Notify us with an explicit statement within 14 days, via:
- Email to automodellista.it@gmail.com, or
- the model withdrawal form (at the bottom of this page).
Return
Return the goods within 14 days of notice to: Automodellista.it di Emanuela Di Carlo, Via Donizetti 23, 21020 Buguggiate (VA), Italy.
Return costs in case of withdrawal are borne by the customer (as indicated before purchase). For a defective or non-conforming product, return costs are borne by us.
You are responsible for any diminished value of the goods resulting from handling other than what is necessary to establish their nature and characteristics.
Refund
We refund you within 14 days of the withdrawal notice (we may withhold the refund until we receive the goods or proof of shipment), using the same payment method you used, at no additional cost.
Exclusions from withdrawal (Art. 59)
For the type of products sold (collectible scale models) the exclusions to the right of withdrawal under Art. 59 of the Italian Consumer Code do not apply. In particular, opening the packaging to examine the model does NOT void the right of withdrawal: the consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning (Art. 57(2) Consumer Code). By way of example, an amount may be withheld for diminished value if the model, the original packaging, the blister or any certificate are damaged or show signs of handling beyond what is necessary to examine the item.
Legal guarantee of conformity (24 months)
Separate from withdrawal: see Terms, Art. 7. In case of a lack of conformity you are entitled to the statutory remedies within 24 months of delivery (12 months for used products, subject to express agreement).
